Voucher Terms
These Terms and Conditions apply to the purchase and use of discount vouchers (“Vouchers”) made available on [Website URL] operated by Your Local Experiences Limited (“we”, “us” or “our”). By purchasing or using a Voucher, you agree to these Terms and Conditions.
1. Our Role as Agent
We operate an online platform through which consumers may purchase Vouchers redeemable with independent third-party suppliers of goods, services or events (“Suppliers”). We act solely as agent for the Suppliers in marketing, selling, and issuing Vouchers on their behalf. The contract for the supply of the goods, services or events described in any marketing of a Voucher is formed directly between you and the relevant Supplier. We do not supply, provide, or perform the goods, services or events redeemable with a Voucher and we do not accept responsibility for the performance of the Supplier’s obligations under that contract.
2. Supplier Responsibility and Our Liability
The Supplier is solely responsible for the goods, services or events to be provided upon redemption of a Voucher, including their quality, safety, fitness for purpose, availability, compliance with description, and compliance with applicable laws and regulations.
To the fullest extent permitted by law, we exclude all liability for any acts or omissions of the Supplier and for any loss or damage arising out of or in connection with the goods, services or events provided by the Supplier.
Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be limited or excluded.
Subject to the foregoing, our total aggregate liability to you arising out of or in connection with a Voucher purchase shall be limited to the price you paid for that Voucher.
3. Voucher Terms of Use
Vouchers are subject to the specific terms stated on the website page detailing the goods, services or events redeemable with the Voucher and price of the Voucher (“Offer Page”) and the Voucher itself, which form part of these Terms and Conditions. Without limitation, the following apply unless otherwise stated:
- Redemption: Vouchers may be redeemed only with the named Supplier and only for the goods, services or events described on the Offer Page. Advance booking or reservation requirements, lead times, and blackout dates may apply and are specified on the Offer Page or Voucher.
- Expiry: Vouchers must be redeemed by the stated Expiry Date. After the Expiry Date, the Voucher is no longer valid and cannot be redeemed, extended, reissued or refunded, unless required by law or expressly stated otherwise. Some Vouchers may have an Expiry Date which is earlier than the date the Offer is advertised for, and it is your responsibility to ensure your Voucher is redeemed before its Expiry Date.
- Restrictions: Vouchers may be subject to restrictions including date or time limitations, location constraints, capacity limits, age or eligibility criteria, and product or service exclusions. Additional charges, service fees, or gratuities may apply and are your responsibility if stated on the Offer Page or required by the Supplier in compliance with applicable law.
- Partial Redemption: Unless expressly stated, Vouchers must be redeemed in a single transaction and no credit or change will be given for any unused portion.
- Non-transferability: Vouchers are not transferable, may not be resold, and have no cash value. They may be gifted only if expressly permitted on the Offer Page and subject to the same terms.
- Lost or Stolen Vouchers: Risk in the Voucher passes to you upon delivery to your account or email. We are not responsible for lost, stolen, damaged, Vouchers used without your authorisation.
- Compliance: You must comply with the Supplier’s reasonable instructions, house rules, health and safety requirements, and applicable laws when redeeming a Voucher.
4. Consumer Rights and Refunds
Your statutory rights are not affected. If you are a consumer in the United Kingdom, you may have a right to cancel your Voucher purchase within 14 days from the day after purchase without giving any reason, in accordance with applicable consumer law, provided the Voucher has not been redeemed and no booking has been confirmed with the Supplier. To exercise the right to cancel, you must notify us using the contact details below within the cancellation period. We will refund you the price paid for the Voucher using the original payment method 30 days of receiving your cancellation notice.
If you encounter any issues with a Voucher or Supplier service, please contact us promptly. We have established clear timelines and escalation procedures to address complaints efficiently. Our team will work with you and the Supplier to resolve any disputes in accordance with legal requirements and our agreements with Suppliers.
In the event that a Supplier is unable or unwilling to honour a Voucher, or fails to provide the goods, services or events as described, we will ensure that you receive a refund or an appropriate remedy without undue delay, in accordance with your statutory rights. This obligation is not discretionary and aligns with our commitment to consumer protection.
In accordance with Regulation 28(1)(h) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the statutory right to cancel within 14 days does not apply to Vouchers for leisure activities scheduled for a specific date or period. This includes, but is not limited to:
- Concerts and live music events
- Theatre and performing arts events
- Sporting events and fixtures
- Any leisure activity with a fixed date or defined period (e.g., tours, experiences, classes, workshops)
Once a Voucher is purchased for or redeemed against such time-specific services, it is non-cancellable and non-refundable. If a Voucher is not tied to a specific date at purchase and remains unredeemed, the cooling-off right may apply until the earlier of expiry of the 14-day period or redemption.
Upon redemption for a specific date, the exclusion applies, and no refund will be available.
This exclusion does not affect your rights if the event is cancelled, materially changed, or not supplied as agreed, in which case our standard remedies policy applies.
No refunds will be given after the expiry date except where required by law or where expressly stated otherwise. We may decline a refund where a Voucher has been partially or fully redeemed, where you fail to attend a booked appointment or breach Supplier terms, or where the grounds for refund fall outside these Terms and Conditions.
5. Data Protection and Privacy
We process personal data in accordance with applicable data protection laws, including the UK GDPR and the Data Protection Act 2018. We act as controller for personal data you provide to create an account, purchase a Voucher, and for associated customer service and fraud prevention. We will share necessary personal data with the relevant Supplier as our processing partner for the purpose of Voucher fulfilment and redemption. The Supplier acts as an independent controller of personal data it processes for fulfilment of the goods, services or events and will handle your data in accordance with its own privacy policy.
Your personal data will not be used for marketing purposes by Suppliers without your explicit consent. We ensure that all consumer data is securely deleted after use, in line with data protection regulations.
Further details about the categories of data we process, purposes, legal bases, retention periods, international transfers, and your rights (including access, rectification, erasure, restriction, objection, and data portability) are set out in our Privacy Notice available at [Privacy Notice URL]. You may contact us or our Data Protection Officer at [DPO contact to be inserted] to exercise your rights. You also have the right to lodge a complaint with the Information Commissioner’s Office.
6. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter or formation, are governed by the laws of England and Wales. The courts of England and Wales shall have non-exclusive jurisdiction. If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your local courts.
